Judgment
Heard learned counsel for the parties.
On 14.08.2026, the following order was passed by this Court :-
“1.Mr. Abhishek Bahuguna, learned counsel for the applicant.
2.Mr. Vishesh Srivastava, learned counsel for the respondent.
3.By order dated 29.05.2026, Shri C.P. Bijalwan, (Retd.) District & Sessions Judge, residing at Dehradun was appointed as arbitrator to decide the disputes between the parties. However, he has expressed his inability to act as arbitrator by communication dated 12.06.2026 addressed to the Registrar (Judicial), High Court of Uttarakhand at Nainital.
4.Learned counsel for the parties agree to the name of Hon’ble Mr. Justice Mahboob Ali, Retired Judge of Allahabad High Court to act as Arbitrator.
5.Accordingly, let his consent and necessary disclosures, as per provisions of Section 11(8), be obtained by the Office within two weeks, and thereafter the matter be listed before this Court.
As per the office report dated 09.09.2026, the necessary disclosures and consent has been received from the proposed Arbitrator - Hon'ble Mr. Justice Mahboob Ali, Former Judge, Allahabad High Court for being appointed as Arbitrator to resolve the dispute(s) between the parties.
Accordingly, Hon'ble Mr. Justice Mahboob Ali, Former Judge, Allahabad High Court is appointed as Arbitrator to resolve the dispute(s) between the parties.
The office is directed to inform the Arbitrator to proceed.
The Arbitration Application stands disposed of accordingly.
