Heard learned counsel for the parties.

On 14.08.2026, the following order was passed by this Court :-

“1.

Mr. Aditya Pratap Singh, learned counsel for the applicant.

2.

Mr. Atul Bhatti, learned CGSC for the Union of India.

By order dated 29.05.2026, Shri Shankar Raj, (Retd.) District & Sessions Judge, residing at Dehradun was appointed as arbitrator to decide the disputes between the parties. However, he has expressed his inability to act as arbitrator by communication dated 20.06.2026 addressed to the Registrar (Judicial), High Court of Uttarakhand at Nainital. \

Learned counsel for the parties agree to the name of Shri Balbir Prasad Gupta, (Retd.) District & Sessions Judge, residing at Dehradun to act as Arbitrator.

5.

Accordingly, let his consent and necessary disclosures, as per provisions of Section 11(8), be obtained by the Office within two weeks, and thereafter the matter be listed before this Court.”

As per the office report dated 09.09.2026, the necessary disclosures and consent has been received from the proposed Arbitrator - Shri Balbir Prasad Gupta, (Retd.) District & Sessions Judge for being appointed as Arbitrator to resolve the dispute(s) between the parties.

Accordingly, Shri Balbir Prasad Gupta, (Retd.) District & Sessions Judge is appointed as Arbitrator to resolve the dispute(s) between the parties.

5.

The office is directed to inform the Arbitrator to proceed.

6.

The Arbitration Application stands disposed of accordingly.

7.

Pending application, if any, also stands disposed of accordingly.
