Judgment

The Secretary, Department of Mines & Geology, Government of Jharkhand, Ranchi, who is present in person, submitted that in compliance of the order dated 22.03.2010 passed in W.P.(C) no. 636 of 2010, the matter was taken up, but, in the meanwhile, the Central Government exercising power u/s 30 of the Mines & Minerals(Development & Regulations) Act, 1957 and Rule 54 of the Mineral Concession Rules, 1960 directed that the Committee constituted for the purpose cannot hear the matter as only the State Government has power to dispose of such application. It has been stated that the State Government has delegated power to the Secretary only Yesterday. Immediately thereafter he has taken step and issued notice to all interested persons, who are 83 in numbers.
The Secretary, Department of Mines & Geology, Government of Jharkhand, Ranchi stated that he has already fixed date for hearing the application and the petitioner''s application shall be disposed of, within two months. He further submitted that he has joined much after the order passed by this Court and as soon as he came to know about the same, he has taken all steps for compliance of the order of this Court.
Though there is inordinate delay in compliance of the order of this Court, since the Secretary, who represents the Government, has joined much after the order of this Court and in view of further development as aforesaid, by way of last chance, an opportunity is being given to the Secretary to comply with the order of this Court, as prayed for.
Accordingly, the prayer of the opposite party no. 2 is allowed. He is granted further time till 30th September,2012 to take final decision on the petitioner''s application. This application stands disposed of with the said direction.
