We have heard Learned Counsel for the Respondents and some of the Respondents, who are appearing in person. The Respondents who are appearing in person seek time to engage Counsel. We find that Asim Sarode, Advocate, is absent. He was absent on previous date also. So we deem it proper to appoint Ms.Supriya Dangare to represent the Applicant as Amicus Curie. She may go through relevant papers and prepare herself in the matter. She may prepare tabular chart regarding the properties and the alleged encroachments as well as breach of the CRZ and may go through the report of the team of Commissioners.

The Learned Counsel appearing for Respondent Nos.8 and 9 submits that the amount of Rs.20,000/- each, to be paid to the Commissioners, may be reduced to Rs.10,000/- per family in respect of each property. The Amount is required to be paid by D.D. drawn in the name of the main Commissioner appointed by the Tribunal i.e. Ms. Nutan Sardessai, the Principal District & Sessions Judge, South Goa, who may make arrange for distribution amongst all team members and may submit the accounts to this Tribunal.

We make it clear that those who have engaged Counsel, may not appear in person on next date, if the amounts are paid to the Commissioner. The Respondents are at liberty to submit their objections to the report of the Commissioner. The pleadings are already completed before the High Court/Principal Bench of NGT, Delhi, and therefore no further opportunity is required, but if at all, any of the contesting Respondent requires such opportunity to file reply affidavit, it may be filed within period of three (3) weeks. We make it clear that on next date we will finally hear the present Application for disposal of the same and no adjournment will be granted. In case the payment will not be made to the Commissioner, the concerned Respondent will face penal action.
