This petition under Article 226 of the Constitution of India is filed seeking a writ of mandamus declaring the action of the 2nd respondent-Station House Officer, Thiruchanur Police Station, Tirupati Rural, Chittoor District, in not taking any action for providing police protection to the petitioner for erection of Roof Top Tower (RTT) on the terrace of building bearing Door No.4-191, Plot No.7, Sy.No.472/1, Mitta Indlu in Vavilala Oteru Village, Tirupati Rural Mandal, as illegal and arbitrary and consequently, sought direction to the 2nd respondent to provide police protection for erection of Roof Top Tower at the aforesaid place.
Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for respondents 1 and 2.
Learned counsel for the petitioner would submit that as there is an obstruction from the neighbours at the work spot in relation to the erection work of Roof Top Tower being carried on by the petitioner, when they sought protection from the Police that the Police are not providing any Police protection to them. Therefore, he would submit that in view of the earlier order passed by this Court in a similar situation in W.P.No.4375 of 2020, to pass a similar order.
Learned Assistant Government Pleader for Home also would submit that in terms of the order passed by this Court in W.P.No.4375 of 2020 that appropriate direction may be given in this petition.
Therefore, in view of the earlier order passed by this Court in W.P.No.4375 of 2020, this writ petition is allowed directing the 2nd respondent to provide Police protection to the petitioner to carry on erection work of Roof Top Tower (RTT) on the terrace of building bearing Door No.4-191, Plot No.7, Sy.No.472/1, Mitta Indlu in Vavilala Oteru Village, Tirupati Rural Mandal, on the written request made by the petitioner to that effect. No costs.
Consequently, miscellaneous applications, pending if any, shall stand closed.
