Learned counsel for the petitioner submits that actually the grievance of the petitioner emanates from the Order passed by the District Commission on 21.12.2015 and the petitioner ought to have filed an appeal against the same in the State Commission. Further submission is that under some misimpression and wrong advice a revision was filed in place of appeal in the State Commission which resulted in the Order dated 04.09.2017 whereby the wrongly filed revision in the State Commission was dismissed. Submission is that petitioner wants to file an appeal against the Order passed by the District Commission and he may be given liberty to do the same.
Learned counsel submits, on instructions, that it does not want to pursue this petition and may be permitted to withdraw the same with liberty to file an appeal in the State Commission.
In the wake of the submissions made by the counsel, present petition stands dismissed as withdrawn. So far as liberty to file appeal in the State Commission is concerned, the petitioner may adopt any legal course permissible under law as may be advised. There is no need for this Commission to grant or not to grant liberty in that regard.
The Registry is requested to send a copy each of this Order to all parties in the petition and to their learned cousel. The stenographer is requested to upload this Order on the website of this Commission immediately.
