Hon’ble Mr. R.N. Singh, Member (J): The present OA has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985, seeking the following reliefs:-

“(i)

That the Hon’ble Tribunal may graciously be pleased to pass an order declaring to the effect that whole action of the respondents not allowing the applicant to perform her duties to the post of TGT (S.Sc.) in SKV-Rathala as per order dt.22.2.2021 on contract basis is illegal, arbitrary and discriminatory and consequently pass an order directing the respondents to allowing the applicant to perform her duties to the post of TGT (S.Sc.) in SKV Rithala as per order dt.22.2.2021 with all the consequential benefits including pay and allowances from due date.

(ii)

That the Hon’ble Tribunal may graciously be pleased to pass an order directing the respondents not to replace the service of the applicant by fresh or junior contract employee after her reinstatement in service.

(iii)

Any other relief which the Hon’ble Tribunal deem fit and proper may also be granted to the applicant along with costs of litigation.”

Ms. Esha Mazumdar, learned counsel for the respondents submits under instructions that during pendency of the OA, the competent authority has taken a decision to re-engage the applicant and in this regard, necessary order/letter is likely to be issued positively within this month, i.e., July, 2021.

Shri Yogesh Sharma, learned counsel for the applicant submits that once the competent authority has already taken a decision, there is no reason or justification for the respondents to seek such a long time for issuing of relevant order/letter and that too, when the applicant is out of job for so many months.

In the aforesaid facts and circumstances, the present OA is disposed of with direction to the respondents to issue necessary order/letter about re-engagement/appointment of the applicant positively within 15 days from today in view of their own decision. If any of the grievances still remains, the applicant shall be at liberty to raise the same in accordance with the law, if so advised.

The OA is disposed of in the aforesaid terms. No costs.
