Judgment
This matter is taken up through hybrid mode.
In this writ petition, the Petitioners have urged for issuing writ of mandamus directing-
“i. The Inspector-in-Charge, Saheed Nagar police Station to give us the CCTV footages of all CCTV cameras of Saheed Nagar Police Station for the dates of 01-04-2022 to 06-04-2022.
ii. The Assistant Commissioner of Police, Sub-Division-V, Bhubaneswar to give us the CCTV footages of all CCTV cameras installed in the premises of the office of the Assistant Commissioner of Police, Sub-Division-V, Bhubaneswar for the dates of 01-04-2022 to 06-04-2022.
iii. The Deputy Commissioner of Police, Bhubaneswar to give us the CCTV footages of all CCTV cameras installed in the premises of the office of the Deputy Commissioner of Police, Bhubaneswar for the dates of 01-04-2022 to 06-04-2022.
iv. The Commissioner and Additional Commissioner of Police, Bhubaneswar-Cuttack Police Commissionerate to ensure compliances of the orders passed by this court containing the above directions.
It is further prayed to –
b. Be kind to direct the respondents of this petition to deliver us the CCTV footages as requested above within seven (7) days of the date of the order passed by this court directing grant of the said CCTV footages.
c. Direct the Inspector-In-Charge, Saheed Nagar Police Station, Bhubaneswar, the Assistant Commissioner of Police, Sub-Division-V, Bhubaneswar and the Deputy Commissioner of Police, Bhubaneswar to submit a copy of the CCTV footages of their premises as urged above from the dates of 01-04-2022 to 06-04-2022 with the Court of Judicial Magistrate First Class-III, Bhubaneswar, Bhubaneswar Civil Court, Khurda District and Sessions Court
d. Pass a reasoned and speaking order on this writ petition.
e. Direct the registry to make the order or judgment passed in respect of this writ petition as NON-
REPORTABLE.
f. Use the email address as mentioned above to make any necessary communication in this matter.
There is also a prayer for interim relief.
Registry is directed to make the Stamp Reporting. According to our view, this writ petition cannot be listed before this Bench, as in terms of the roster we do not have the assignment to entertain the writ petition of this category.
Let the matter be listed before the appropriate Bench.
The Petitioner No.1, who is appearing in person has brashly asked orally for a certificate to appeal, as we understand, under Article 134A of the Constitution. Since the writ petition has not been disposed of, there cannot be any question of issuance of certificate to appeal.
