Judgment

This matter is taken up through Hybrid Arrangement.
Heard the petitioner no.1, who appears in person and learned counsel for the State.
The grievance of the petitioners is that despite a case has been filed by the petitioners in the court of learned J.M.F.C.-III, Bhubaneswar praying for obtaining the CCTV footage from 01.04.2022 to 06.04.2022, neither her interim prayer has been heard nor has any order been passed. Therefore, the petitioner is constrained to approach this Court by filing the present petition.
Learned counsel for the State submits that a similar prayer has been made in the court of learned J.M.F.C.-III, Bhubaneswar under Section 156(3), Cr.P.C. and the said case is pending since 18.03.2023.
The petitioner no.1 submits that she is going to withdraw the case pending before the learned J.M.F.C.-III, Bhubaneswar within three days since she does not want to pursue both the matters with identical prayer before two different forums.
In view of the above, this Court directs the police to preserve the CCTV footages from 01.04.2023 to 06.04.2023 of office of the Assistant Commissioner of Police, Bhubaneswar and Saheed Nagar Police Station. The I.I.C., Saheed Nagar Police Station is directed to appear before this Court tomorrow (05.04.2023) through Virtual Mode at 2.00 P.M. and produce the CCTV footage before this Court. It is made clear that the police shall not alter or destroy any part of the CCTV footage of the above period.
List this matter tomorrow (5th of April, 2023) at 2.00 P.M.
In the meantime, the petitioner is directed to delete the names of the opposite parties and only mention their designations in the memo of party.
