M/s. Akja Exim Private Limited vs Chairman And Ors

These appeals are respectively filed by M/s. Akja Exim Private Limited who is manufacturing Toor Dhall and Urd Dhall, M/s. Shree Lakshmi Dhall Products who is manufacturing Toor Dhall and Urd Dhall, M/s. S.M. Enterprises who is manufacturing Washing Powder and M/s. Lesun Enterprises who is manufacturing Detergent Cake in their respective units, challenging the respective impugned orders passed by the Tamil Nadu State Pollution Control Board (TNPCB) directing closure of the units under Section 33-A of Water (Prevention and Control Pollution) Act, 1974 and under Section 31-A of Air (Prevention and Control Pollution) Act, 1981.

When the appeals were heard for admission, the learned counsel appearing for respondent, TNPCB took notice and sought time to get instructions. Learned counsel appearing for the TNPCB today submitted that subsequent to the impugned orders, the respective appellants have filed applications for Consent under both Water (Prevention and Control Pollution) Act, 1974 and Air (Prevention and Control Pollution) Act, 1981.

Learned counsel appearing for the appellants submitted that direction be issued to the respondents to dispose the applications expeditiously.

Learned counsel appearing for the TNPCB submitted that the applications for Consent filed by the appellants will be considered and orders will be passed expeditiously.

In view of the submissions, the appeals are disposed as follows: The TNPCB shall consider the applications for Consent submitted by the appellants under Water (Prevention and Control Pollution) Act, 1974 and Air (Prevention and Control Pollution) Act, 1981 and pass appropriate orders in accordance with law, as expeditiously as possible at any rate within a period of one month from today.

The appeals are disposed accordingly, with no order as to costs.
