Judgment
Heard the learned counsels appearing for the parties and perused the documents on record.
Referring to order dated 11.11.2016 in B.A. No. 8659 of 2016 and order dated 11.07.2017 in B.A. No. 5142 of 2017, the learned counsel for the petitioner submits that allegation against the petitioner is of harboring the main accused namely, Saddam Ansari. The petitioner is in judicial custody since 17.05.2017.
The learned A.P.P. has opposed the prayer for grant of bail.
In view of the order granting bail to the main accused and having regard to the facts and circumstances of the case, the petitioner, above?named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Rajmahal in connection with Rajmahal P.S. Case No. 106 of 2016 corresponding to G.R. No. 363 of 2016, with condition that he shall deposit a sum of Rs. 10,000/- as interim compensation to the victim which shall be paid to her through the trial Court.
The District Legal Services Authority, Sahibganj shall also take prompt steps for rehabilitation of the victim.
The instant application is allowed. Let a copy of this order be sent to the trial Court through FAX.
