The complainant has sought the refund of the amount deposited with the Respondents along with the interest.
On perusal of the record it is seen that no one is appearing on the behalf of the Respondents from the very beginning of issuance of notice to the Respondents. Even a cost of Rs. 50,000/- was imposed on Respondents for non-appearance and for non-filing the reply to the complaint on 24.11.2021. The cost has also not been deposited till date.
We also take note that no one has appeared before the Authority on 18.01.2022, 23.02.2022, 15.03.2022 and 10.05.2022. Even today no one has appeared on behalf of the Respondents. As such Authority will be constrained to proceed ex-parte on the next date of hearing.
In the interest of justice, another opportunity is given to the Respondents to file reply by 15.07.2022 and appear before the Authority on the next date of hearing.
The office is directed to issue fresh notices to Sh. Prabha Shankar Singh & Sh. Ashok Atri, Directors & Sh. Lalit Gera, Authorized Representative of the Company M/s Delhi Infratech Ltd.
The case is posted for further hearing on 24.08.2022 at 02:30 p.m.
