Mrs. Vidya Sharma vs State of H.P. and Others

Kurian Joseph, C.J.—The Writ Petition is filed with the following prayers:

i) That the tenure service rendered by the Applicant from 1.7.1987 to 31.3.1994 may kindly be allowed to be counted towards increments.

ii) That the tenure service of the Applicant from 1.7.1987 to 31.3.1994 may kindly be directed to be added into service for the purpose of pension.

iii) That the pay fixation of the applicant may kindly be authorized to be made from 1.7.87 to 31.3.1994 on account of its being a continued spell of service.

The Petitioner submits that the issue is covered in favour of the Petitioner in a judgment of this Court in, Paras Ram v. State of Himachal Pradesh and anr CWP(T) No. 7712 of 2008 and the same has been implemented. The Petitioner may point out this aspect before the first Respondent. In the event of the Petitioner approaching the first Respondent within one month from today, producing also copy of the judgment referred to above, needful shall be done in accordance with law and also in the light of the judgment referred to above. In case the Petitioner is similarly situated the benefits flowing out of the above consideration shall be disbursed to the Petitioner within another one month.

The Writ Petition is disposed of.
