By Mallika Arya, AM;

This Contempt petition has been filed by the applicant against the respondents/contemnors for willful and deliberate disobedience of order dated 01.05.2025 passed by this Tribunal in Original Application No.200/637/2024. The operative part is as under:

“18.

Accordingly, the Original Application No.634/2024 is allowed. The transfer order dated 25.06.2024 (Annexure A-1) only with respect to Sushma Dixit (the applicant) is quashed. Consequently, the relieving order dated 26.06.2024 (Annexure A-2) is also quashed. Since, in place of the applicant, the respondent no. 4 has already joined, therefore, the respondents are directed to accommodate the applicant at Bhopal or any suitable place of her choice submitted by the applicant herself and pass appropriate order to that effect forthwith preferably within a period of 30 days from the date of receipt of certified copy of this order. The applicant is also directed to submit her joining at a place where she is posted in compliance of this order.”

2.

Heard the counsel for the parties.

3.

Since the respondent no. 4 had already joined, in place of

the applicant, therefore, the respondents were directed to accommodate the applicant at Bhopal or any suitable place of her choice submitted by the applicant herself. In compliance of said order, applicant submitted only one preferred station i.e. Bhopal vide her representation dated 06.06.2025. No other choice station was indicated in the aforesaid representation. However, due to non-availability of vacancy for the post of TGT (Biology) at Bhopal, her case was not considered. Later she again submitted her representation dated 09.05.2025 with station preferences Bhopal, Vidisha, Sehore and Raisen. However, no vacancies were available at these Stations also. The applicant was further asked to give revised options but she has not done. We find that the case of the applicant has been duly considered by the respondents vide memorandum dated 19.06.2025 (Annexure P/4). Due to non-availability of vacancy at the choice station her request could not be acceded to.

4.

In view of the above, applicant is at liberty to submit her revised list of choice stations except those mentioned in her representation dated 09.05.2025 to respondents. On receipt of revised list of choice stations, respondents /contemnors are directed to comply with order passed by this Tribunal in aforesaid O.A., within a period of two months.

5.

Accordingly, this Contempt Petition is disposed of with above direction.
