In the present case, the RP had filed IA No. 317/2024 stating that the repayment plan stands rejected by the CoC. Vide order dated 11.06.2024, it was clearly stated that the debtor shall be entitled to file an application for bankruptcy under Chapter IV. Till date, no application for bankruptcy has been preferred by the debtor. In view of the same, it is considered appropriate to disposed off CP No. (IB)-96/94(1)/JPR/2021 with a liberty to the debtor/creditor to seek permission for filing an appropriate application for initiating of bankruptcy, if required.
