Hon’ble Shri B. Anand, Member (A)

1.

Learned counsel for the applicant states that the applicant is aggrieved by the impugned order dated 19.09.2025 as well as the letter dated 03.08.2026 whereby the respondents are preparing to recover an amount of Rs. 9,39,918/- from the applicant on the ground that the adhoc services of the applicant from 23.07.1992-08.03.2004 for grant of financial upgradation under the ACP/MACPS has been wrongly reckoned with and consequently his pay has been wrongly refixed with effect from 23.07.2004.

2.

Learned counsel for the applicant submits that the issue in the present O.A. is squarely covered by the judgment of a coordinate Bench of this Tribunal in O.A. No. 1043/2023 titled Dr. Mustehasan and Ors. Versus Union of India and Anr. Dated 09.09.2025. Learned counsel submits that the applicant has submitted a representation dated 10.08.2026 against the proposed recovery and another representation dated 30.09.2025 regarding the arbitrary withdrawal of the ACP/MACP benefits after more than two decades resulting in refixation of his pay.

3.

Issue notice to the respondents. Ms. Deepa Rai, learned counsel, who appears on advance service, accepts notice. She seeks a reasonable period of time to file reply.

4.

However, at the admission stage, without going into the merits of the case, the O.A. is disposed of with a direction to the respondents to dispose of the pending representations of the applicant dated 30.09.2025 and 10.08.2026 by way of a reasoned and speaking order as expeditiously as possible and preferably within four weeks’ from the date of receipt of a certified copy of this order. It is further directed that till the above order is complied with, the respondents are restrained from doing the proposed recovery.

5.

The O.A. stands disposed of in the aforesaid terms. There shall be no order to costs.
