Judgment
The subject matter of the present Writ Petition is an order dated 05.08.2026 passed by the Central Administrative Tribunal, Hyderabad Bench ('CAT') in O.A.No.567 of 2026, which was filed challenging an Office Order dated 24.06.2026 insofar as it relates to the transfer of the petitioner from Employees' State Insurance Corporation (ESIC) Medical College and Hospital, Sanathnagar, Hyderabad, to ESICH Hospital, Korba, Chhattisgarh, for a period of two years.
By the impugned order dated 05.08.2026, the CAT directed the respondents/ESIC to consider and dispose of the representation of the petitioner dated 29.06.2026, by passing a speaking and reasoned order, duly taking into consideration the Office Memorandums dated 06.06.2014 and 08.10.2018 issued by the Department of Personnel and Training (DoPT), cited by the petitioner, within a period of four weeks. The matter was directed to be listed on 18.09.2026.
The petitioner, in the meantime, filed the present Writ Petition on 24.08.2026.
It is relevant that the time granted by the CAT to the respondents for considering the petitioner's representation has not yet expired, since the respondents have time till 04.09.2026 to comply with the said direction.
We, hence, do not find any reason to interfere with or entertain the present Writ Petition. However, the petitioner is at liberty to make a representation to the respondents, and upon receipt of such representation, the respondents shall comply with impugned order dated 05.08.2026 within a period of two weeks from 31.08.2026.
W.P.No.28270 of 2026, along with all connected applications, is accordingly disposed of in terms of the above. There shall be no order as to costs.
