Judgment
After hearing the Learned Counsel Mr. Abhishek Anand appearing for the Appellant and also Learned Counsel Mr. Kunal Anand appearing for the Respondent No.3- 'Bank of India', it is represented by Mr. Abhishek Anand, Learned Counsel for the Appellant that the Respondent No.3- 'Bank of India' had received upfront payment of Rupees Three Crores from the Appellant on 23.09.2021 without prejudice to its rights/ interests. Hence, at the request of the Learned Counsel for the Appellant Mr. Abhishek Anand and also Learned Counsel for the Respondent No.3 Mr. Kunal Anand, the matter is adjourned to 05.10.2021 for further consideration of the instant 'Appeal'.
It is open to the respective Learned Counsel(s) appearing for the parties to file the necessary material paper(s)/ correspondence that exchanged between them on the subject of receipt of upfront payment of Rupees Three Crores or any other settlement issue touching the merits of the main Appeal.
The 'Office of the Registry' is directed to List the matter on 05.10.2021.
