IA 1208/2020 : The Counsel for the Applicant submits that she has filed the Application on the same matter, vide Application No.849/2020 on 05.03.2020; duplication happened due to COVID and filing e-copy in addition to the hard copy. In view of the same IA 1208/2020 has become infructuous and hence is dismissed. IA 1208/2020 is disposed of.
IA 849/2020: It is an Application represented by Ms. Maitri Malde for withdrawal of the company petition filed under Section 9, read with Section 12A of IBC, 2016. Mr. Vishal Tiwari, Counsel for the Petitioner is also present. Mr. Vishal Tiwari confirms that he has authorized Mr. Rohit through Power of Attorney who has signed Form FA prescribed for withdrawal of the petition. As the Petitioner has submitted his application under Section 12A, read with Regulation 30A(1)(a) of the IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, the prayer for withdrawal of the Company Petition is allowed. Accordingly IA 849/2020 is allowed and the CP No.4303 of 2019 is closed.
