This is an application under Rule 8 of IB (Application to Adjudicating Authority) Rules, 2016 seeking the withdrawal of IB-219/ND/2022 which is an application filed under Section 9 of IB Code, 2016.
We have heard the submissions made by the Learned Counsel for the Petitioner as well as gone through the contents of the application including the Memorandum of Settlement filed alongwith the application. After having gone through the contents of the application, we permit the Applicant i.e., Operational Creditor to withdraw the IB-219/ND/2022 unconditionally in terms of Rule 8 of IB (Application to Adjudicating Authority) Rules, 2016. The matter is dismissed as withdrawn. The case papers and connected folders may be consigned to record room. Dasti of this order is allowed.
