Judgment
ORDER
Ld. Counsel appears for the Resolution Professional. Ld. Counsel for the Applicant. Ld. Counsel appears for the Respondents/Corporate Debtors. We find from the records that on 06.09.2019 this Tribunal passed the following orders:-
“Learned Counsels for the parties are present. The Petition is admitted and Corporate Insolvency Resolution Process (CIRP) is unfolded. IRP proposed by the Financial Creditor is appointed. Detailed order in this regard to follow.”
On 05.08.2024, the Registry was directed to issue notice to the Applicant and Respondents.
On 03.09.2024, Mr. S.N. Gautam, Ld. Counsel had appeared on behalf of the Applicant and had sought time to take instructions.
The Registry was directed to issue notice to Mr. Abhay Kumar, the Interim Resolution Professional.
Today, Ms. Udita Singh, Ld. Counsel appearing for Mr. Abhay Kumar, the Interim Resolution Professional stated that Interim Resolution Professional has filed an affidavit on 03.10.2024, stating therein that the order dated 06.09.2019 initiating CIRP and appointing Mr. Abhay Kumar as Interim Resolution Professional was never communicated nor was the order uploaded on the DMS portal of the NCLT and therefore, Interim Resolution Professional was unaware of the proceedings and could not take any steps.
Mr. Vaibhav Tyagi, Ld. Counsel appearing for the Corporate Debtor has stated that parties have settled the matter and therefore the matter should be closed.
In view of the above submissions, matter stands closed.
IB-129/2019 is disposed of accordingly.
