ORDER
A ‘Memo’ dated 17.10.2023 is filed before the ‘Office of the Registry’ of this ‘Tribunal’, that the ‘Appellant’ is desirous of withdrawing the instant Comp App (AT) (CH) (Ins) No.106/2023 on the file of this ‘Tribunal’. This fact is not disputed on behalf of the 1st Respondent side, represented through Learned Counsel Mr. Ujjwal Jain. It comes to be known that in IA No.1490/2023, the ‘Adjudicating Authority’ / ‘National Company Law Tribunal’, Hyderabad Bench passed, an Order dated 09.10.2023, and directing the ‘Resolution Professional’ to release the sum of Rs.7,59,76,114 in favour of the ‘Appellant’.
Considering the fact, that the ‘Appellant’ through his ‘Memo’ dated 17.10.2023 filed before the ‘Office of the Registry’, of this ‘Tribunal’, had expressed his desire to withdraw the instant comp App (AT) (CH) (Ins) No.106/2023. The instant ‘Appeal’ is ‘dismissed as withdrawn’, No costs. The connected pending Interlocutory Applications if any are closed.
