IA-2254/2022 :
Counsel for the Resolution Professional is present and through the present Application has sought necessary permission of this Tribunal with regard to calling and convening the COC Meeting with the Agenda, inter alia, raising of interim prayer of the Applicant payment of the CIRP cost and appointment/change of the statutory Auditor of the Corporate Debtor.
The detailed circumstances behind the aforesaid prayer has been discussed in Paragraphs, 9, 10, 11, 13 & 14 of the present Applicant.
After going through the averments made by the RP in the aforesaid paragraphs as well as hearing the submissions made by Counsel, we hereby allow the present Application in terms of Section 23 read with Rule 11 of the NCLT Rules, 2016.
The prayer as made under Page-9 against prayer (a) stands allowed in full.
In view of this, the present Application stands disposed of.
