ORDER
IA No.414/2023
This application has been filed for replacement of current IRP, Mr. Pradeep Kumar Ray with the new RP namely Mr. Mukesh Chand Jain.
In the resolution passed by the CoC in the meeting held on 18th August, 2023 vide agenda Item No. B-2 (page 42 and 43), which has been passed by 100 % voting majority of the CoC in the said meeting, replacement of existing IRP Mr Pradeep Kumar Ray with Mr Mukesh Chand Jain who has given his consent to act as Resolution Professional, is approved .
In compliance of the previous order dated 5th September, 2023, an additional supplementary affidavit has been filed vide Diary No.2464 dated 13th September, 2023 to the effect that the dues pertaining to the erstwhile IRP Mr. Pradeep Kumar Ray have been paid. Mr. Pradeep Kumar Ray is also present in person and states that all the dues have already been paid, and therefore he has no objection in case RP is changed and a new RP is appointed.
In view of the averments made in the application as well as the supplementary affidavit and the oral submissions made by the Ld. Counsel representing the incoming RP, the present application is allowed and substitution of RP is permitted, and accordingly, Mr. Mukesh Chand Jain is allowed to act as RP.
Accordingly, IA No.414/2023 stands disposed off.
IA No.383/2023
The said IA has already been disposed of vide order dated 5th September, 2023 while taking on record the progress report.
It is pointed out by the Ld. Counsel for the RP that the present application 383/2023 has been filed for placing on record the constitution of the Committee of the Creditors in respect of the Corporate Debtor, which is at page 12 of the application.
Accordingly, the order dated 5th September, 2023 with respect to the present IA No.383/2023 is modified to the extent that the Constitution of the CoC is taken on record. IA stood disposed off accordingly.
