Petitioners seek quashing of FIR No. 78/2023 of PS Kishangarh for offence under Section 498A/406/34 IPC on the ground that parties have compromised the disputes. Today, petitioners no.1 and 3 on behalf of petitioners have appeared and respondent no.2 has appeared in her individual capacity, all of whom are identified by SI Rajendra Kumar and their respective counsel. The petitioners no.2 and 4 being the mother-in-law and sister-in-law of respondent no.2 have not appeared, but in view of the overall circumstances of this case, no purpose would be served by adjourning the matter for their appearance.
I have spoken with the parties in Hindi. It is submitted by both sides that all their disputes now stand settled. Marriage between petitioner no.1 and respondent no. 2 stands dissolved by decree of divorce dated 19.11.2024. No child was born in this marriage. The respondent no. 2 has accepted a full and final settlement amount of Rs. 27,50,000/- which includes her claim for entire stridhan. As submitted by both sides, out of full and final settlement amount, a sum of Rs. 27,00,000/- has been deposited by petitioners with the Registry of this Court and that amount shall be released to respondent no.2 depending upon outcome of this petition.
Considering the aforesaid, I am satisfied that it would not be in the interest of justice to push the parties through trial.
Therefore, the petition is allowed and consequently FIR No. 78/2023 of PS Kishangarh for offence under Section 498A/406/34 IPC and the proceedings arising therefrom are quashed. Pending application stands disposed of.
The Registry is directed to release the amount of Rs. 27,00,000/- to the respondent no.2 which was deposited by petitioners on 16.10.2024 in terms with their mediation settlement, along with the interest accrued thereon. For that purpose, list before the Registrar General on 01.05.2025.
