Judgment
The applicant has filed this OA, seeking the following reliefs:-
"8.1. That the Hon'ble Tribunal may be graciously be pleased to allow this application and quash the impugned orders.
8.2. That the Hon'ble Tribunal may be pleased to direct the respondents to refund the amount of subsistence allowance which has wrongly and arbitrarily recovered from the applicant.
8.3 That the Hon'ble Tribunal may be graciously pleased to pass any other or further order as may be deemed fit and proper on the facts and circumstances of the case.
8.4. That the Hon'ble Tribunal may further be graciously pleased to grant costs against the respondents and in favour of the applicant."
Nobody appeared for the applicant on 05.12.2017 and 13.02.2018. On 04.05.2018 and 02.08.2018, matter was adjourned on request of proxy counsel for the applicant. Finally, after repeated adjournments 36 times and keeping the matter on board 3 times, the matter was listed again today but nobody appears for the applicant even today.
Hence, in view of the continuous non-appearance of the applicant, the OA is dismissed in default and for want of prosecution. No costs.
