The applicant was working as Chief Loco Inspector in the pay scale of Rs.6500-10500 as per 5th CPC recommendations. According to him, his pay has been incorrectly fixed on implementation of 6th CPC recommendations. The applicant retired on 31.03.2013 after completion of 33 years of unblemished service. He made a representation on 28.10.2013 to Divisional Railway Manager, Delhi, claiming the payment of arrears of stepping up of pay and payment of Travelling Allowance for the months of December 2012 and March 2013 but no response was received. The applicant also sent reminders but to no avail. Subsequently, a letter dated 12.12.2015 was sent to the applicant, denying receipt of TA bills for the period December 2012 to March 2013. It was stated that arrears of stepping up of pay from July 2003 to December 2004 had already been paid.

Notices were issued. Respondents have filed reply stating that the supplementation bill was prepared by APO/Bills/NDLS of Rs.15,172 and the bill was sent to Accounts Department. Out of the amount of Rs.15172/-, bill of Rs.9154/- was not passed by Accounts due to more than 10 years old and want of waiver of internal check and rest of bills for the period from July 2003 to December 2005 have already been passed by Accounts Department.

It is stated by the respondents that it is clear from the facts of the case that the applicant claimed for the payment of Rs.15172/- as arrear and that Rs.6018/- have been paid to the applicant as a part payment and credited to his account. The case of remaining amount of Rs.9154/- is under process for waiver of internal check being 10 years old record as per queries of Finance Department.

Respondents have further submitted as regards the claim for travelling allowance of Rs.6071/- that the said bill has not been received by the Bill Section.

Heard the learned counsel for the parties at length and perused the record.

It appears from the perusal of the record that due to technicalities, applicant's bill for the amount of Rs.9154/- has not been processed because it is more than 10 years old. For this, the blame cannot be shifted on the employee who has rendered long unblemished service. Even if there is delay, it is on account of lethargy on the part of the respondents. The Tribunal finds that the aforesaid amount of Rs.15172/- is due and payable to the applicant minus the payment made, if any. This amount be paid to the applicant within a period of 60 days.

As regards the TA claim, it is submitted by the respondents that the bill has not been received by the Bill Section. The applicant may, therefore, resubmit the copies of the bills, which the respondents shall also consider within a period of 60 days.

With the above directions, the OA is disposed of.
