The matter has been heard via video conferencing due to lockdown imposed on account of the COVID-19 pandemic.

Heard Mr. Bajarangi Lal, learned counsel for the petitioner; Mr. Madhav Prasad Yadav, learned GP 23 for the State and Mr. Vivek Anand Kumar, learned counsel for the Accountant General.

At the very outset, learned counsel for the petitioner submitted that during the pendency of the writ petition, he has been visited with a punishment order, copy of which has been brought on record by way of Annexure-A to the supplementary counter affidavit filed by respondent no. 6, which is order dated 31.12.2018 contained in Memo No. 3593 passed by the District Education Officer, Siwan. Accordingly, he prayed that the matter be disposed off with liberty to challenge the same in a freshly constituted proceeding.

Having regard to the aforesaid, the writ petition stands disposed off with liberty to the petitioner to move before the appropriate forum, in accordance with law, against the aforesaid order of punishment passed against the petitioner.
