The applicant is challenging the selection procedure adopted by the respondents for promotion from Group ‘C’ and Group ‘B’ to the

post of AEN against 70% departmental quota vacancies. The applicant’s name was not in the selection list. On 4.3.2021, a supplementary written

test was also held and objections were invited. The applicant has put forth his objections on 10.3.2021. But instead of giving reply to his objections, the

respondents have supplied him a copy of the answersheet. Being not satisfied with the same, the applicant has approached this Tribunal without

exhausting departmental remedy.

In view of the above facts and circumstances, we are of the considered view that let applicant make a detailed representation stating his grievance

in detail describing the correct allocation of marks question-wise referring the answer sheet provided to him by the respondent within two weeks time.

The respondents may consider and decide the same and if it is found that there is a requirement to appoint an expert committee in this regard, let the

same may be appointed to examine the same and the result of the expert will be communicated to the applicant as expeditiously as possible and in any

case within eight weeks from the date of receipt of such representation from the applicant.

The OA is disposed of at the admission stage itself in the aforesaid terms. No costs.
