Learned counsel for the applicants submits that the applicants in the present OA are identically situated to the applicants in OA No. 2938/2026, inasmuch as one of the applicants herein was appointed and is working as IT Assistant and the other two applicants are working as Massagers on contractual basis. It is submitted that the applicants had approached the respondents seeking grant of equal pay for equal work on par with regular employees and the said representation dated 17.10.2025 is still pending consideration before the respondents.

2.

Learned counsel further submits that in OA No. 2938/2026 dated 17.08.2026, the Tribunal, with the consent of learned counsel for the parties, had disposed of the OA at the admission stage with a direction to the respondents to consider the pending representation of the applicants and pass a reasoned and speaking order within the stipulated period.

3.

In view of the above, and since the present OA is stated to be identical to OA No. 2938/2026, the present OA is also disposed of in similar terms. Accordingly, the respondents are directed to consider the pending representation of the applicants dated 17.10.2025, pass a reasoned and speaking order thereon, in accordance with law, within a period of eight weeks from the date of receipt of a certified copy of this order.

4.

It is, however, made clear that the filing of the present OA shall not be construed against the applicants in any manner or prejudice the consideration of their case by the respondents. The respondents shall consider the representation independently and in accordance with the applicable rules and instructions.

5.

It is further made clear that we have not entered into the merits of the case.

6.

The OA is disposed of in the aforesaid terms at the admission stage itself. Pending MAs, if any, also stand disposed of. No costs.
