Judgment
R.R.K. Trivedi, J.—Heard Counsel for the applicant.
This revision is against the order dated 15th April, 1994, passed by Principal Judge, Family Court, Kanpur Nagar by which maintenance of Rs. 300/- p.m. has been fixed for the wife and son.
I have perused the order and I do not find any error of law.
Learned Counsel for the applicant, however, submitted that so far as arrears are concerned, applicant may be granted some time to pay and he may be absolved of paying the same at the rate of Rs. 50/- p.m. Learned Counsel for the applicant has further submitted that the entire arrears of maintenance at the rate of Rs. 300/- from the date of 1st May, 1992 upto the date of 15th April, 1994 shall be paid by the applicant within six months.
Considering the facts, this revision is rejected with the observation that so far as arrears are concerned applicant shall be at liberty to pay the same within six months that is on or before 31st January, 1995. However, the amount of Rs. 300/- payable in pursuance of the impugned order shall be paid regularly. In case of default, applicant shall not be entitled for the benefit of the relief under this order.
