The pe oner incarcerated in the FIR cap oned above, has come up before this Court under Section 439 CrPC seeking bail.

Custody cer ficate dated 01.08.2023 filed by State counsel today in the Court is taken on record. State counsel on instruc ons from HC Hardeep Singh submits that trial is at fag end and the ma er now fixed for 18.08.2023 for recording of the statement of the accused under Section 313 Cr.P.C.

A er arguing at length, counsel for the pe oner confines his prayer for extension of bail granted to pe oner vide order dated 23.03.2023 passed in CRM-M-13752-2023. He submits that trial is fixed for 18.08.2023 for recording statement of accused and pe oner undertakes to appear on each and every date of hearing without a single default. He further submits that he has no objec on in case of his non-appearance, trial Court cancel his bail. He further submits that the previous bail bonds/surety bonds be also extended.

Considering the medical situa on of the pe oner, the prayer is allowed and interim order dated 23.03.2023 is extended ll 30.09.2023. It is clarified that there is no need to furnish fresh bail bonds/surety bonds and the previous bail bonds/surety bonds are also extended ll 30.09.2023. It is further clarified that if the pe oner fails to a end even a single date except due to the medical constraints and the inabili es because of the medical condi on then on this ground alone, the bail shall be cancelled.

Given above, the present pe on is disposed of. All pending miscellaneous application, if any, stand disposed of.
