Judgment
This Criminal Petition has been filed by the petitioners/accused Nos.1 to 4 seeking to quash the proceedings in C.C.No.962 of 2025 on the file of the learned XV Additional Chief Metropolitan Magistrate at Hyderabad.
Heard Mr.Syed Jameel Ahmed, learned counsel for the petitioners, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, appearing on behalf of respondent No.1 and Mr.K.Jamali, learned counsel for respondent No.2.
Learned counsel for both parties submitted that during the pendency of the present Criminal Petition, at the instance of the well wishers, relatives and elders, the parties have settled the disputes pending between them and entered into compromise and filed Joint Memo. Accordingly, the parties have filed I.A.Nos.2 and 3 of 2026 seeking permission to compromise the matter and to record the compromise entered between them by quashing the proceedings.
This Court vide order, dated 29.07.2026, directed the parties i.e., the petitioners and respondent No.2, to appear before the High Court Legal Services Committee, Hyderabad, on or before 07.08.2026 for their identification. In compliance of the said order, the Secretary, High Court Legal Services Committee, has submitted report, dated 07.08.2026, stating that all the parties were duly identified with the copies of their Aadhar Cards. It is further stated that all the parties have willfully and without any coercion entered into compromise.
Learned Additional Public Prosecutor has not opposed the same.
In view of the said report and also in view of the compromise entered between the petitioners and respondent No.2 as well as the submissions made by the respective parties, I.A.Nos.2 and 3 of 2026 are allowed. Consequently, the proceedings in C.C.No.962 of 2025 on the file of the learned XV Additional Chief Metropolitan Magistrate at Hyderabad, are hereby quashed against the petitioners/accused Nos.1 to 4.
Accordingly, the Criminal Petition is allowed, subject to payment of Rs.5,000/- (Rupees five thousand only) to the High Court Legal Services Committee, Hyderabad and Rs.5,000/- (Rupees five thousand only) to the Telangana High Court Advocates Association, Hyderabad, by the petitioners, on or before 22.08.2026.
Miscellaneous applications, pending if any, shall stand closed.
JOINT MEMO
1.It is submitted that Respondent No.2 lodged a complaint dated 25.10.2024 before WPS South East Zone (Hyderabad) Police Station, at Saidabad, Hyderabad against the Petitioners herein. Pursuant to the said complaint Police registered a case vide FIR No.242/2024 dated 25.10.2024 U/s.85, 115(2) BNS, 3,4 DP Act, against the Petitioners and shown them as Accused No.1 to 4.
2.It is submitted that Petitioner No.1/Accused No.1 herein with Respondent No.2 both are leading happy marital life along with their School going children, in pursuance of the above said Reasons Respondent No.2 decided to withdraw the above said complaint and compromise the matter.
3.It is submitted that due to intervention of elders and well wishers the matter has been settled amicably between the parties, as such it is just and necessary to quash the above case and to record the compromise statement between the Petitioners and Respondent No.2.
It is therefore prayed that this Hon'ble Court may be pleased to record the compromise statement and Quash the proceedings against the Petitioners/Accused No.1 to 4 in CC 962 of 2025 on the file of Honble XV Addl. Metropolitan Magistrate, Manuranjan Complex, at Hyderabad in the interest of justice and pass such other order or orders may deem fit and proper in the circumstances of the case.
