Judgment
By the Order dated 02.05.2023 the respondent was directed to explore the terms of amicable settlement. The counsel for the respondents informs that the respondents have proposed to settle the matter for Rs.21,13,456/- as ex gratia amount in the peculiar facts and circumstances of this case. The counsel for the appellant, however, requests for Rs.21,50,000/- which has been accepted by the learned counsel for the respondents.
The present appeal is decided in terms of the consent of the parties and the respondents shall pay a sum of Rs.21,50,000/- to the appellant within six weeks from today. So far as the letter of subrogation as well as handing over of key is concerned the respondents shall hand over a letter of subrogation which shall be signed by the appellant within one month and he shall file an affidavit before the respondent as to whether key is with the appellant or not.
The appeal is disposed of in view of the consent of the parties as above. This Order shall not be treated as a precedent. .
