Judgment
[1] This Court, with satisfaction, records the efforts put in by Mr. K. De, learned counsel appearing for the respondent-Insurance Company, in making the respondent-insurer agree to pay a sum of `34,000/- (Rupees thirty four thousand) in lump sum, what stands awarded by the learned Tribunal vide impugned award dated 26.02.2015 passed by learned Member, Motor Accident Claims Tribunal (2), West Tripura Agartala, in case No. Title Suit (MAC) 275 of 2011, titles as Smt. Gita Paul vs. Shri Jamal Hossein & Others.
[2] Faced with this situation, Mr. S. Lodh, learned counsel appearing for the claimant-appellant, under instructions, states that the offer made by the insurer is acceptable to the claimant.
[3] This Court fully appreciates the efforts put in by learned counsel, Mr. S. Lodh and Mr. K. De, in making the parties understand the advantage and benefit of having the matter amicably resolved. Also this Court is appreciative of the fact that the learned counsel were able to help the parties to agree to the sum of aforesaid compensation, which is just fair and reasonable.
[4] Mr. K. De, learned counsel appearing for the respondent-insurer, states that the said amount of `34,000/- shall positively be paid within a period of 4(four) weeks from today.
[5] Such statement is accepted and taken on record.
[6] The appeal stands disposed of on the following mutually agreed terms:
(a) Impugned award 26.02.2015 passed by learned Member, Motor Accident Claims Tribunal (2), West Tripura Agartala, in case No. Title Suit (MAC) 275 of 2011, titles as Smt. Gita Paul vs. Shri Jamal Hossein & Others, shall stand modified to the aforesaid extent;
(b) The payment of `34,000/- (Rupees thirty four thousand) in lump sum, what already stands awarded by the Tribunal, shall be paid within a period of 4(four) weeks.
(c) This amount shall be paid by the insurer to the claimant within a period of 4(four) weeks, directly disbursing the same to his bank account, particulars of which shall be furnished by him within a period of one week from today.
Pending application(s), if any, also stands disposed of.
Send down the lower Court records forthwith.
