This petition is filed seeking direction to the first respondent to comply with the order passed in Cr.M.P.No.2698 of 2023.

When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent police submitted that as per the order passed in Cr.M.P(MD).No.2698 of 2023, the second respondent police has conducted the enquiry. During the course of enquiry, it was found that it is a civil dispute between the parties and thereafter, it was closed. He further submitted that RCS notice was also served on the petitioner.

At this juncture, the learned counsel for the petitioner would submit that RCS notice has not been served to the petitioner so far.

Recording the submission made by the learned Government Advocate (Criminal Side), nothing survives for further adjudication and hence, this Criminal Original Petition stands dismissed as infructuous.

Further the second respondent police is directed to serve RCS notice to the petitioner and the petitioner is at liberty to workout his remedy through the appropriate proceedings.
