Judgment

Heard Mr. S. Thapa, learned counsel for the petitioner.
Also heard Mr. B. Bhattacharjee, learned AAG for the State respondent. This is an application filed for grant of pre-arrest bail, wherein the petitioner has been impleaded as an accused on the basis of an FIR dated 18.12.2022 filed at Khliehriat Police Station, East Jaintia Hills District by the complainant who is a police official.
At this juncture, it would not be necessary to go into the details of the FIR, suffice it to say that the plea of the petitioner is that he is apprehending arrest on the basis of proceedings as a result of the said FIR.
At this stage, the Court is of the opinion that the C.D of Khliehriat P.S. Case No. 101 (12) of 2022 under Section 307/506/145/34 IPC read with Section 21 (1) of MMRDA Act is to be produced to know the extent of investigation and the present status of the case. Accordingly, the prosecution is directed to produce the C.D on the next date fixed.
In the meantime, as prayed for by the petitioner, interim bail is hereby granted.
List this matter on 07.03.2023 for production of C.D and further orders.
