This Writ Petition is filed for speedy disposal of Ext.P5 C.P. No.16 of 2020 pending before the Labour Court, Ernakulam, which is a claim petition filed by legal representatives of the original employee Saju George, who passed away on 9.6.2023.
A report was called from the Presiding Officer, Labour Court, Ernakulam. In the report dated 23.11.2023. It is stated that similar claim petitions in between the same parties are pending as C.P. Nos.16/2020, 38/2014 (stayed), 4/2021, 54/2021, 36/2022 and 71/2022 and are posted to 15.12.2023. The presiding officer has asked for six months time for completing the proceedings.
It is seen that the original order was passed as per Ext.P1 on 30.8.2019, which has attained finality. Thereafter, the Claim Petition is filed. In such circumstances, there will be a direction to the Labour Court, Ernakulam to take up Ext.P5 claim petition and pass final orders within four months from the date of receipt of a copy of this order.
O.P.(L.C.) is disposed of as above.
