Judgment
This MA is registered on the basis of the report received in compliance of the order of the Tribunal dated 29.05.2023 passed in OA No.363/2023.
In the OA No.363/2023, complaint was made that during the course of construction of tunnel between Marola and Chintala village muck was generated which was being disposed of in river Satluj polluting the water and damage was caused to the forest and ecology.
Tribunal by order dated 29.05.2023 had formed a Joint Committee comprising of Himachal Pradesh pollution Control Board and District Forest Officer, Shimla with a direction to the Committee to look into the matter, collect relevant information and if any violation is found, take appropriate remedial and prevention actions. OA was accordingly disposed of with a direction to the Committee to submit the report before the Registrar General.
Report submitted before Registrar General by the Committee reveals that EC for damage to the ecology amounting to Rs. 5 lakh for five dumping sites on M/s. Sunni Dam HEP vide letter dated 07.07.2023 has been imposed and that in compliance thereof the unit has deposited Rs. 4 Lakh.
Report further states that during the fresh inspection on 25.07.2023, it was observed that during the monsoon and rise of water level in river Satluj most of the retaining structures were submerged or washed away. Hence, compliance is required to be done on the basis of the report of the Joint Committee and HPPCB is required to ensure the said compliance.
As per the report, project proponent is utilizing the surface water, therefore, Member Secretary, HPPCB will also examine the permissibility/ permission for utilization of such water and if any violation is found, take necessary action in this regard.
Thus, MA is disposed of directing the Member Secretary, HPPCB to take appropriate steps to ensure that compliance in terms of the report of the Joint Committee is done within a period of three months.
