The present writ petition has been filed for following reliefs:-

“i. For the issuance of appropriate especially writ(s), directions, in the nature Certiorari for setting aside the order/orders, of order of the Insurance Ombudsman, Patna dated 27 June 2025, (Annexure-10) to this petition whereby and whereunder the complaint of the petitioner no 1 has been found to be unsustainable dismissed and accordingly to safeguard the right of the petitioner no. 1 and petitioner no.2 guaranteed under Article 14 and Article 21 of the Constitution of India especially Right of Life which includes right to health that inherently includes the protection of one's health a prerequisite for living meaningful a life besides other human rights that includes the right to life with dignity and which has been infringed and put up at stake which requires to be restored and protected by this Hon'ble Court.

ii. For the issuance of appropriate writ(s), directions, order/orders, the especially in the nature of Mandamus directing and commanding upon respondent authorities to submit the relevant records before this Hon'ble Court and after hearing the parties remand the matter back to respondent no.1 for fresh disposal in accordance with law, by taking into account the question of established medical practices and emerging trends of medical practices;”

It has been pointed out by the learned counsel for the petitioners that alternate efficacious remedy is available before the consumer forum and as such he seeks permission to withdraw the present writ petition with a liberty to utilise the consumer forum as prescribed in the law.

In view of above submission, learned counsel for the petitioners are permitted to withdraw the present writ petition.

Accordingly, the present writ petition is hereby disposed of as withdrawn with aforesaid liberty.
