Judgment
I.A No. 213/2024 is listed today wherein the prayer at the instance of the Appellant No. 2 is for listing the appeal and the pending applications for hearing. The perusal of the documents enclosed with the application reveals that the appeal was filed with some delay and the Tribunal by order dated 11.07.2013 had condoned the delay and thereafter had rejected the application for review of that order by order dated 28.11.2013 and these orders were subject matter of challenged before the Hon’ble Supreme Court in Civil Appeal No. 274 of 2014 & Civil Appeal No. 69 of 2014 wherein the Hon’ble Supreme Court had passed the common order dated 06.01.2014 issuing notice and staying the proceedings before the Tribunal.
In view of the above the Tribunal by order dated 10.11.2014 had adjourned the matter sine die with liberty to the parties to mention after orders are passed by the Hon’ble Supreme Court.
Hon’ble Supreme Court by the common order dated 23.01.2024 has dismissed the Civil Appeals by recording the statement of the counsel for the appellant therein that the appeals became infructuous. In the above background the present application being I.A No. 213/2024 seeking the hearing of the appeal and pending applications before the Tribunal has been filed.
On due consideration and taking into account the circumstances which are mentioned above, I.A No. 213/2024 is allowed. Since the civil appeal has been dismissed by Hon’ble Supreme Court therefore now the Appeal pending before Tribunal is to be taken up for hearing.
Let notice be issued to all the concerned parties intimating the next date of hearing. Appellant is directed to serve all the parties and file affidavit of service atleast one week before the next date of hearing.
