Judgment

[1] Present Mr. D.P. Sahu, learned counsel for the petitioner; Mr. Niranjan Sanasam, learned Government Advocate for the State respondents; and Mr. H.S. Paonam, learned senior counsel for respondent No. 3.
[2] This matter is listed as per the noting dated 11-06-2025 put up by the Registry that the writ petition was restored in terms of the judgment dated 22-04-2025 passed by the Hon’ble Supreme Court in Civil Appeal Nos. 3797 of 2025 and 3798 of 2025.
[3] Mr. H.S. Paonam, learned senior counsel for respondent No. 3, submits that by para No. 21 of the judgment of Hon’ble Supreme Court, judgment and order in the writ appeal was set aside and judgment and order of the learned Single Judge dated 23-08-2023 in WP(C) No. 304 of 2023 was restored. Hence, the matter is not required to be listed before this Court.
[4] This Court has perused the material on record. WP(C) No. 304 of 2023 was dismissed by the learned Single Judge of this Court vide order dated 23-08-2023 and in the writ appeal, the order of the learned Single Judge was set aside by a Division Bench in WA No. 75 of 2023 and by the judgment of the Hon’ble Supreme Court, the decision of the Division Bench was set aside and the decision of the learned Single Judge was restored.
[5] In the circumstances, WP(C) No. 304 of 2023 is only restored by the Hon’ble Supreme Court and nothing more is required to be agitated. The same is closed in terms of the earlier order.
