Judgment
V.N. Sinha, J.—Heard learned counsel for the petitioner, Sunni Wakf Board and the Secretary, Wakf Committee of Anjuman Islamia, Katihar, respondent no.8.
Petitioner is the tenant of Wakf Committee of Anjuman Islamia, Katihar bearing Estate No.344. The shop which was under occupation of the petitioner required renovation. For renovation of the said shop petitioner was asked to occupy another shop of the wakf estate. In spite of renovation of the shop of the petitioner he has not shifted back to his shop.
Having heard counsel for the parties, it is directed that petitioner should occupy the earlier shop by tomorrow(16.4.2011) and complete the shifting by 29.4.2011. In the event, petitioner does not vacate the other shop which is in his occupation today he be evicted therefrom by force on 30.4.2011. For any other relief petitioner may approach the civil court of competent jurisdiction.
With the direction aforesaid, the writ application is disposed of.
