Virender Singh, C.J.—I.A. No. 259 of 2016

For the reasons carved out in the instant application and there being no serious objection from the other side, the delay of 26 days in filing the accompanied appeal is hereby condoned.

I.A. No. 259 of 2016 stands disposed of accordingly.

Heard both the sides.

Dismissal of W.P.S. No. 2128 of 2014 filed by the appellant-writ petitioner-Md. Kalim Uddin Ansari and 21 others has given them all a cause to file the instant Letters Patent Appeal.

In our considered view, the agreement entered into between the respondent- Management of Eastern Coalfields Limited and Association of the displaced persons is not a statutory agreement therefore, not enforceable. Not only that terms and conditions of the agreement were disputed by the Eastern Coalfields Limited asserting that there is no such agreement, keeping all relevant aspects into consideration the learned Writ Court ultimately dismissed the writ petition vide impugned order dated 13th October, 2015. We, finding no infirmity in the same on any count, refrain from showing our indulgence. Appeal on hand, thus merits dismissal.
