Counsel for the parties are present.

This criminal revision is directed against the order dated 22.08.2023 passed by the learned Additional Sessions Judge-II Cum special Judge (Cyber Crime Cases) Dhanbad in M.C.A. No. 659/2023 arising out of Cyber Case No. 13/2022, Putki P.S. Case No. 89/2022 whereby the petition for discharge filed on behalf of the accused/petitioner on 07.02.2023 u/s 354/504/506/34 of IPC & 66(A)/66(E)/67 I.T Act has been rejected which is now pending in the court of learned District and Additional Sessions Judge-II Cum Special Judge (CBI, Cyber Crime, Electricity Act), Dhanbad.

Mr. Atanu Banerjee the learned counsel for the petitioner on instruction submits that he may be permitted to withdraw this petition with liberty to raise all the points which have been raised in the present petition and others which may be available to the petitioner at the stage of trial.

The learned counsel for the state has no objection to the prayer made by the petitioner.

Accordingly, this criminal revision is dismissed as withdrawn.

It will be opened to the petitioner to raise all the points which have been raised in this petition or which may be available to the petitioner under law at the stage of trial.

Withdrawal of this case will not prejudice the case of either party before the learned court.
