Learned counsel for the parties are present.

This criminal revision was filed on 28.07.2023.

This criminal revision has been filed for setting aside the judgment dated 12.09.2022 passed by the learned Sessions Judge, East Singhbhum, Jamshedpur, in Criminal Appeal No. 62 of 2021 whereby the learned Court has acquitted the Opposite Parties Nos. 2 and 3 by setting aside the judgement and order dated 28.08.2020 passed in G.R. No. 1080 of 2012 corresponding to T.R. No. 63/2020 the Opposite Parties were convicted for the offences under sections 420/34/387/34/506/34 of I.P.C and were sentenced to undergo R.I. for 3 years and to pay a fine of Rs. 10,000/ or in default S.I. for 6 months u/s 420/34 of 1.P.C and R.1. for 3 years and to pay Rs. 10, 000/-fine or in default S.I. for six months u/s 387/34 of I.P.C and further to undergo R.I. for 3 years and to pay Rs. 10, 000/- fine and in default S.I. for 6 months.

Learned counsel for the State has submitted that the present revision is not maintainable. The petitioner has a remedy to file an appeal under proviso to Section 372 of the Cr. P.C.

At this, learned counsel for the petitioner seeks permission to withdraw this revision application with liberty to take steps as per law.

The learned counsel for the State has no objection to the prayer for withdrawal.

In view of the submissions made, this revision application is dismissed as withdrawn.

Liberty is reserved with the petitioner to take steps as per law in connection with the impugned order.

Office is directed to return the certified copy of the documents filed in this case to the counsel for the petitioner upon being replaced by the photocopy duly certified to be true by the learned counsel for the petitioner .

Since this revision is dismissed as withdrawn, pending interlocutory application is closed.
