Judgment
Venkateswarlu Nimmagadda, J
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus Declaring the action of the 2nd respondent in conducting height measurement as part of physical measurement with an inaccurate digital height measuring machine which gives every time a different reading and resulted in disqualifying of the petitioner vide memo dated 15.09.2023 though he had qualified with more height in earlier recruitment of 2019 conducted by the same respondent board as illegal, arbitrary, discriminatory against principles of natural justice and violative of Articles 14, 16, 19 and 21 of the Constitution of India and consequently direct the 2nd respondent to retake the height and chest of the petitioner herein forthwith with manual measuring system and allow the petitioners herein to participate in the further selection process in the interest of justice and to pass such other order or orders...”
Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
Learned counsel for the petitioner submits that suffice if a direction is given to respondent authorities, more particularly, to the 2nd respondent to consider the representation dated 16.09.2023 submitted by the petitioner to the 2nd respondent requesting to conduct re-measurement through standard measurement equipment by Expert of Weights and Measurements Department.
Learned Government Pleader appearing for the respondents would submit that the representation dated 16.09.2023 submitted by the petitioner would be considered by the respondent authorities in accordance with law, within a reasonable time.
Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for the respondents, in view of the facts and circumstances of the case, without touching merits of the case, this Court is of the considered view that the present Writ Petition can be disposed of, directing respondent Nos.2 to 4 to consider the petitioner’s representation dated 16.09.2023 in terms of Order passed by the Coordinate Bench of this Court in Writ Petition No.46872 of 2023 and batch and pass appropriate orders within a period of two(02) weeks or on or before 14.10.2023. Learned Government Pleader for the respondents is directed to inform this order to the respondents.
With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
