Judgment

Heard learned counsels for petitioners and for the State.
The petitioners are apprehending their arrest in connection with Pathargama PS Case No.129 of 2025, for offence registered under section 317(5) of BNS, 2023 and section 11 of Prevention of Animal Cruelty Act, 1960, pending in court of learned Sub Divisional Judicial Magistrate, Godda.
Learned counsel for petitioners submits that the petitioners happened to be the owners of the vehicles in questions and the allegations are made that bovine animals were being carried in the said vehicles. He also submits that purchaser of bovine animals has hired the vehicles and the petitioners have nothing to do with the allegations made. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph no.15.
Learned State counsel opposes prayer and submits that illegally the bovine animals were being carried on the said vehicles.
Considering that the petitioners are the owners of different vehicles and have got no criminal antecedent as aforesaid and it has been pointed out that the said vehicle was hired by the purchaser of the bovine animals, I am inclined to grant anticipatory bail to petitioners.
Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Godda, in connection with Pathargama PS Case No.129 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
