Judgment
Pursuant to the order dated 20.03.2023, Counsel for the Appellant has field I.A. No. 1674 of 2023 for withdrawal of instant Appeal i.e. Company Appeal (AT) (Insolvency) No. 563 of 2021 in which he has annexed the Annexure-2 at page 11 of the Affidavit which is certificate issued by IP Manish Agarwal, Resolution Professional dated 01.03.2023 which read hereunder:

We hereby confirmed that we have received the entire balance payment of total Resolution amount of Rs. 24 Crore by RTGS on 07/02/2023 along with interest amount of Rs. 3,40,94,200/- @ interest rate of 8.5% per annum on the late payment of resolution amount in respect of Multiwal Pulp and Board Mills Private Limited. It is also confirmed that above amount is accepted by all COC members and distributed to them.”
Let the aforesaid Affidavit be kept on record.
In view of the aforesaid certificate issued by the Resolution Professional full and final payments have been made as per the agreement in between the parties, therefore, Counsel for Appellant submits that he may be permitted to withdraw the instant Appeal.
Permission is accorded. In view of the submissions made by the Ld. Counsel for the Appellant the instant Appeal is dismissed as withdrawn. No costs.
