The present petition has been filed under Section 528 of BNSS, 2023 (erstwhile Section 482 Cr.P.C.) seeking issuance of directions to the official respondents, particularly respondents No.2 and 3, to add the appropriate offences under Section 109 of BNS, 2023 (corresponding to Section 307 IPC) and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, in case FIR No.119 dated 03.07.2026, registered under Sections 115(2), 118(2), 351(2) and 3(5) of the BNS, 2023 (erstwhile Sections 323, 326, 506 and 34 IPC), at Police Station Sadar Ahmedgarh, District Malerkotla.

Learned counsel for the petitioner submits that the petitioner has preferred a representation/complaint dated 14.07.2026 (Annexure P-4) to respondent No.2-Senior Superintendent of Police, Malerkotla, but no action has been taken so far. Learned counsel also submits that the petitioner would be satisfied if directions are issued to respondent No.2-Senior Superintendent of CRM-M-44581-2026 -2-Police, Malerkotla, to look into the aforesaid representation/complaint dated 14.07.2026 (Annexure P-4) and take appropriate steps in a time bound manner.

On the asking of the Court, Mr. P.S. Pandher, AAG, Punjab, accepts notice on behalf of respondents No.1 to 3.

Mr. Gaurav Vir Singh Behl, Advocate has put in appearance on behalf of respondents No.4 & 5 and filed the Vakalatnama in Court, which is taken on record.

I have heard learned counsel(s) for the parties and perused the material available on record.

Keeping in view the facts and circumstances of the case and the limited prayer made by the petitioner, the present petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, Malerkotla, to consider and decide the representation/complaint dated 14.07.2026 (Annexure P-4) of the petitioner in accordance with law within a period of six weeks from the date of receipt of certified copy of this order.
